Terms & Conditions
Effective Date: 1st July 2026
These Terms & Conditions apply to all inspections, consultancy services, reports and professional advice provided by Focus Exteriors ("we", "our", "us"). By engaging our services, you ("the Client") agree to these Terms & Conditions.
1. Scope of Services
Focus Exteriors provides independent landscape and horticultural consultancy services, including inspections, technical assessments, reports and project advisory services.
Our services are based on professional observations, practical industry experience and relevant qualifications and are provided solely for the purpose agreed with the Client.
2. Visual, Non-Invasive Inspections
Unless otherwise agreed in writing, inspections are visual and non-invasive.
We do not undertake:

Destructive testing
-
Excavation
-
Removal of finishes or structures
-
Underground investigations
-
Internal building inspections
-
Testing of concealed services
-
Laboratory testing
Assessments are limited to areas that are reasonably accessible at the time of inspection.
3. Limitations of Services
Focus Exteriors is not a provider of:

Structural engineering services
-
Geotechnical engineering
-
Civil engineering
-
Land surveying
-
Building certification
-
Hydraulic engineering design
-
Electrical certification
-
Plumbing certification
-
Pool safety certification
-
Arboricultural certification
-
Legal advice
Any comments relating to these disciplines are general observations only and must not be relied upon as specialist professional advice.
Where appropriate, we may recommend that further assessment be undertaken by a suitably qualified professional.
4. Inspection Reports
Reports represent our professional opinion based on the visible condition of the property at the date and time of inspection.
Conditions may change after the inspection due to weather, use, maintenance, construction activity or other factors beyond our control.
Our reports should be considered together with any relevant building, pest, engineering or specialist reports where applicable.
5. Reliance on Reports
Reports prepared by Focus Exteriors are commissioned for the exclusive use of the Client named in the report and for the specific purpose for which they were requested.
No third party may rely upon, reproduce, distribute or use the report without the prior written consent of Focus Exteriors.
Where a report is provided to another party with the Client's permission, Focus Exteriors accepts no greater responsibility than that owed to the original Client under these Terms & Conditions.
6. Client Responsibilities
The Client is responsible for:

Providing accurate information.

Ensuring safe and reasonable access to the property.

Obtaining permission from the property owner where required.

Advising us of any known hazards before the inspection.
7. Fees and Payment
Fees are charged in accordance with our published pricing or any written quotation.
Unless otherwise agreed:

Payment upfront of 50% upon booking of inspection.

Reports will be withheld until final payment has been received.

Hourly work will be invoiced on a as per job basis or weekly basis,
-
A deposit of 2 hours may be required up front for hourly works and payment due within 7 days of invoice
-
Additional work requested outside the agreed scope will incur additional fees.
8. Intellectual Property
All reports, photographs, drawings, recommendations and other documents remain the intellectual property of Focus Exteriors unless otherwise agreed in writing.
Reports are prepared solely for the named Client and must not be reproduced, distributed or relied upon by third parties without our written consent.
9. Liability
To the maximum extent permitted by law:

Our liability is limited to the amount paid for the service.

We are not responsible for hidden defects, latent conditions or matters that could not reasonably be identified during a visual inspection.

We are not liable for losses arising from reliance on information outside the agreed scope of services.
Nothing in these Terms excludes rights that cannot legally be excluded under Australian Consumer Law.
10. Confidentiality
Information obtained during the course of an inspection will be treated as confidential and will not be disclosed except:

with the Client's consent;
-
where required by law; or
-
where necessary to deliver the agreed services.
11. Cancellations
Appointments cancelled with less than 24 hours' notice may incur a cancellation fee.
Where travel has already commenced or significant preparation has been undertaken, reasonable costs may also be charged.
12. Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia.
Any disputes shall be subject to the jurisdiction of the courts of New South Wales.
